Dashrobe is an online marketplace connecting Customers (apparel buyers) with Vendors (apparel sellers) and Courier Partners for pickup and delivery of clothing and accessories. Dashrobe facilitates orders via its app/website and payment processing. Dashrobe does not sell products itself; it provides a platform.
Summary
Account & Registration: All users (Customers and Vendors) must create an account, be of legal entity, and provide accurate personal or business information, including contact details, store details and payment method. Users are responsible for account security and all activity under their account.
User Obligations: Customers must use Dashrobe lawfully, obey any local restrictions, and not misuse services (e.g. no prohibited goods). Vendors must list accurate product information, meet quality standards, fulfill accepted orders, and comply with applicable laws. Both must respect intellectual property and third-party rights.
Delivery & Logistics: Dashrobe may arrange delivery using its own couriers or third-party carriers. Dashrobe is responsible for goods in transit up to delivery; any loss or damage occurring during transit is Dashrobe's liability. After successful delivery, any defects or damages are the Vendor's responsibility. Vendors may optionally insure high-value items, but in absence of vendor insurance, Dashrobe's liability ends upon delivery. Customers agree to inspect items immediately and report transit issues (e.g. damage in delivery) within a short time window.
Pricing, Payments & Fees: Dashrobe will charge Vendors based on the agreed price and a service fee or commission. Vendors set product prices and descriptions. Payment processing details will be handled by Dashrobe. All taxes and transaction fees will be communicated clearly. Dashrobe may adjust fees or add new payment options, with notice to users.
Liability: Dashrobe disclaims all warranties; services are provided “as is”. Dashrobe is not liable for indirect, incidental, or consequential damages (e.g. lost profits). Dashrobe disclaims liability for third-party courier actions except as expressly provided. Vendors are fully liable for product quality, legal compliance, and claims arising from their products.
Indemnification: Each user (Customer or Vendor) agrees to indemnify and hold harmless Dashrobe (and its officers/affiliates) from any losses or claims arising from their breach of these terms, misuse of the service, or violation of third-party rights.
Privacy & Data: Dashrobe's Privacy Policy governs data collection and sharing. User data (names, addresses, payment info) is collected for order fulfillment and is protected under applicable law. Dashrobe will not share personal data outside necessary parties without consent.
Dispute Resolution: Users should first seek informal resolution. If a dispute arises (e.g. item defect), the Customer should contact the Vendor. If unresolved, escalate to Dashrobe support. If still unresolved, parties may pursue binding arbitration or court action per the agreed “Governing Law” clause. In some jurisdictions Hyderabad, unresolved e-commerce disputes can be taken to a Consumer Commission, and Dashrobe will appoint a Grievance Officer to respond within 48 hours and resolve within 30 days.
Jurisdiction & Amendments: This Agreement is governed by the laws of the applicable jurisdiction chosen by Dashrobe or by applicable consumer law. Key clauses requiring local customization include Governing Law, Privacy standards, Consumer return rights, India's e-commerce rules, and dispute venue. Dashrobe may amend these terms, with notice to users; continued use implies acceptance.
Definitions
- Dashrobe means Dashrobe, Inc. and its affiliates, operator under legal entity Dashrobe Technologies India Private Limited. Dashrobe Services means the online marketplace and related services enabling Customers to request and receive delivery of Apparel from Vendors (including the Dashrobe website, mobile app, payment services, and customer support).
- Customer means an end user who places an order for Apparel via Dashrobe Services.
- Vendor means a registered seller of Apparel on Dashrobe, offering products for sale.
- Account means a user account created on Dashrobe (for Customers or Vendors) under which the user may use the Services.
- Order means a purchase request submitted by a Customer through Dashrobe for a Vendor's product, including any Payment and delivery request.
- Courier Partner means an independent third-party individual or company contracted to pick up and deliver products.
- Content includes any text, graphics, images, videos, or other information users upload or send via Dashrobe.
Services
Dashrobe provides an online platform only: it connects Customers with Vendors and coordinates delivery via delivery partner, but Dashrobe “does not manufacture or sell products”. Vendors list Apparel products and describe them accurately. Customers select products and payment method, and Dashrobe processes the order. Dashrobe may provide order tracking, notifications, and customer support. Dashrobe may update or modify the Services (e.g. add features, change providers) with notice.
Account Registration
- Eligibility: Users need to have a legal entity registered and must be at least 18 years old.
- Accuracy of Information: During registration, you must provide your legal name, address, email, phone number, Business details and valid payment details. You agree that this information is true, accurate, and complete, and to update it promptly if it changes. Inaccurate or incomplete information may prevent use of Dashrobe Services or lead to account suspension.
- Account Responsibility: You are responsible for all activity under your Account. Keep your password and login secure. Only one account per person/company is allowed unless Dashrobe expressly permits otherwise. Do not share your account or allow unauthorized use. If you suspect unauthorized use, notify Dashrobe immediately.
- Lawful Use: You may only use your Account and the Services for lawful purposes. You must not allow anyone under the legal age to place orders or receive deliveries unless accompanied by a responsible adult.
User (Customer) Obligations
- Order Information: Customers must ensure their order details (shipping address, product options, etc.) are correct before placing an order.
- Payment: Customers must pay all amounts (product price + delivery fee + taxes) at checkout. If using stored payment methods, you authorize Dashrobe to charge the amount due. You are responsible for any bank or card fees.
- Prohibited Items: Customers must not request delivery of prohibited or illegal goods. (E.g., hazardous materials, regulated items.) If an order involves such items, Dashrobe may cancel it and refuse delivery.
- Cooperation: Customers should be available to receive deliveries or arrange pickup from a safe location. If you cannot be reached or refuse delivery, the order may be returned at your expense.
- Communication: Use the Dashrobe app or website to communicate with Vendors or Dashrobe support about orders. Do not harass or abuse Vendors, Couriers, or Dashrobe staff.
Vendor Obligations
- Product Listings: Vendors must list only Apparel products they are authorized to sell. All listings must be truthful and not infringe others' intellectual property. Vendors warrant that they have all rights to sell the products. Misleading listings (wrong description, false pricing) are grounds for account termination.
- Order Acceptance: Vendors should promptly acknowledge and accept or decline each order. If declining, promptly notify the Customer via the platform. Once accepted, the Vendor must prepare and hand off the item for delivery without undue delay.
- Quality and Accuracy: Vendors are responsible for the quality, safety, and accuracy of their products. Products must match the description (size, color, material) provided to the Customer. Any issues (defects, wrong item) are the Vendor's responsibility.
- Delivery Coordination: Vendors must package items securely for transit and label them correctly. Vendors should coordinate with the Courier Partner: e.g., confirm pickup location/time. If Dashrobe schedules a pickup, the Vendor should have the item ready at the agreed time.
- Returns & Refunds Policy: Vendors must clearly publish their return, refund, cancellation, and exchange policy on their Dashrobe storefront and adhere to it. Vendors may modify these policies, but any change applies only to future orders. Policies must comply with applicable consumer laws. Vendors are responsible for processing any refunds, replacements, or returns for product defects or post-delivery issues. Dashrobe is not responsible for vendor-specific refunds.
- Compliance: Vendors must comply with all relevant laws (product safety, consumer protection, tax, etc.). Vendors must collect and remit any required sales tax or GST and comply with export/import rules.
- Indemnification: Vendors agree to indemnify Dashrobe for any claim arising from their products or breach of their obligations.
Delivery, Pickup, and Logistics
- Delivery Arrangements: Dashrobe will arrange a Courier Partner to pickup the product from the Vendor and deliver to the Customer. Dashrobe may use its own couriers or third-party carriers.
- Transit Liability: Dashrobe assumes liability for any loss or damage that occurs during transit, up to the point of delivery to the Customer. Customers must inspect deliveries immediately; any evidence of damage in transit must be reported to Dashrobe within 24 hours of delivery. Dashrobe will compensate or arrange a replacement for goods damaged in delivery.
- Post-Delivery Defects: Once delivered and accepted by the Customer, Vendor is responsible for any defects or damages arising thereafter (e.g. latent defects, wrong size). The Customer must contact the Vendor directly for returns or refunds on these grounds. The seller (Vendor) must cover defective items and even pay return shipping for defects. Faulty goods can be rejected within 30 days for a full refund. Dashrobe's liability for the product ends upon delivery.
- Third-Party Couriers: When Dashrobe engages independent couriers or allows third-party logistics, Dashrobe acts as a coordinator only. Dashrobe has no liability for the acts or omissions of these third parties beyond its stated transit liability. Customers assume the risk of using such third-party delivery services. (For example, any injury to a courier or delays due to third-party faults are outside Dashrobe's control.)
- Delivery Failure: If a delivery attempt fails (wrong address, no one home, refusal), additional attempts or return to Vendor may incur a fee. Customers may pay a re-delivery fee or bear return shipping costs if an order is returned to the Vendor.
Pricing, Payments, and Fees
- Product Pricing: Vendors set product prices (in Indian currency). Customers pay the listed price plus any delivery fees and taxes.
- Payment Processing: Dashrobe processes all payments on behalf of Vendors. Accepted payment methods (Credit cards, UPI, Netbanking wallets, COD, etc.) will be specified on the platform. Payment details are securely handled under Dashrobe's Payment Policy.
- Service Fees: Dashrobe charges a service fee and will be disclosed to Vendors in advance and may be adjusted with notice. Customers may pay a convenience fee for certain payment methods.
- Refund of Fees: If an order is fully cancelled before pickup, all charges (including Dashrobe fees) will be refunded to the Customer. If a delivery is completed but a partial refund is later issued (e.g. due to a discount or return), the corresponding Dashrobe fee will also be prorated and refunded or credited.
- Taxes: All prices exclude applicable taxes (sales tax, VAT, GST, etc.), which Dashrobe will charge where required by law. Any change in tax rates will adjust final prices.
- Cash on Delivery (COD): If COD is offered, terms include: eligibility restrictions (e.g. order value, regions), requirement for exact payment at delivery, and applicable COD fees. For example, Dashrobe may charge a nominal Cash on Delivery (COD) fee, and customers may face an RTO (returned-to-origin) fee if they refuse a COD delivery. Fraudulent misuse of COD (e.g. repeated refusals) may lead to order cancellation or account blocking. These specifics will be provided in the checkout details.
Returns, Refunds, Cancellations & Exchanges
Vendors define their own return/cancellation policies (subject to store Policies). If an item is damaged in transit, Dashrobe will compensate or replace it; if an item is defective or wrong after delivery, the Vendor must provide a refund or replacement under its policies. Cancellation of orders by Customers must follow the Vendor's stated terms, but cannot be done after the Vendor has already shipped the item.
- Vendor-Controlled Policies: Vendors establish their own policies for returns, refunds, cancellations, and exchanges. These policies must be clearly posted and comply with applicable law. Dashrobe itself does not impose a single returns policy; instead, Customers must follow the Vendor's rules.
- Defective or Incorrect Items: If the received item is defective, damaged (not during transit), or not as ordered, the Customer should immediately contact the Vendor to arrange a return or exchange. The Vendor must honor valid claims (refund, repair or replacement) under its policy and in compliance with law. Faulty goods returned within 15 days must be refunded. A Vendor must cover return shipping for defects.
- Transit Damage: If an item is damaged during Dashrobe's delivery, the Customer should report this to Dashrobe support promptly. Dashrobe will facilitate a refund or replacement at no extra cost to the Customer. In such cases, Dashrobe will seek compensation from its courier partner or insurer. The Vendor is not responsible for damage incurred in the courier's possession.
- Order Cancellation: A Customer may cancel an order only before the Vendor has shipped the item. After pickup/shipping, cancellation is not permitted (the Vendor has already begun performance). If cancelled in time, Dashrobe will refund any amounts paid (product + delivery). If a Customer cancels late, Dashrobe may allow a return subject to the Vendor's policy (possibly with restocking or return shipping fees as per that policy).
- No-Return Items: Certain items (e.g. perishable goods, customized items) may be final sale; Vendors must specify any such exceptions. Customers should not assume all apparel is returnable beyond defect or misdescription.
- Refund Timing: Approved refunds will be processed within 7–14 business days (timing depends on payment method). Dashrobe will notify the Customer once refund is initiated. Vendors must also process vendor-paid refunds promptly.
- Partial Refunds/Repairs: If only part of an order is faulty, a partial refund is possible at Vendor's discretion. Vendors should repair damaged items if feasible instead of refunding.
Dispute Resolution
- Informal Resolution: Users agree to resolve issues cooperatively. If a Customer has complaint about a Vendor's product, the Customer should first contact the Vendor. If the Vendor does not resolve it, the Customer may contact Dashrobe Support. Similarly, Vendors should respond to Customer issues professionally.
- Escalation: If a dispute is not resolved within a reasonable time (e.g. 5–7 business days), the Customer can escalate to Dashrobe's mediation team. Dashrobe may assist in mediating a solution.
- Formal Steps: If mediation fails, parties may proceed to legal remedies. Dashrobe's standard terms specify the chosen governing law and jurisdiction. Users may opt for binding arbitration (if agreed) or small claims court as allowed.
- Mandatory E-Commerce Procedures: In some jurisdictions, Dashrobe must follow local e-commerce dispute rules. For instance, in India Dashrobe (as an e-commerce platform) will appoint a Grievance Officer to acknowledge consumer complaints within 48 hours and resolve within 30 days. Unresolved consumer complaints can be taken to the relevant Consumer Disputes Commission. Dashrobe will cooperate with such bodies.
Dispute Resolution Timeline
- 0d: Customer files complaint (damaged/defective item)
- 1–2d: Vendor reviews and responds
- 3–5d: If unresolved, Customer escalates to Dashrobe Support
- 6–10d: Dashrobe mediates between Customer and Vendor
- 11–30d: If still unresolved, escalate to arbitration or consumer forum
Limitation of Liability
- General Disclaimer: Dashrobe Services are provided “as is” and “as available.” Dashrobe disclaims all warranties not expressly stated, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Dashrobe does not guarantee availability, uninterrupted access, or error-free operation.
- No Consequential Damages: Under no circumstances will Dashrobe or its affiliates be liable for any indirect, incidental, special, punitive, or consequential damages arising out of use of the Services or content. This includes loss of revenue, data, or business. Even if Dashrobe was advised of the possibility of such damages, this limitation applies to the fullest extent permitted by law. (Some jurisdictions do not allow exclusion of certain damages; if required by law, Dashrobe's liability will be capped to the minimum extent such laws require.)
- Third-Party Services: Customers use third-party courier services at their own risk. Dashrobe has no liability for any loss or damage resulting from services provided by independent couriers, except as explicitly set forth (transit damage coverage described above).
- Currency of Liability: Dashrobe's maximum liability for any claim is limited to the greater of: (a) the total fees paid by the Customer for the specific order in question, or (b) the minimum statutory damages under applicable law.
- Survival: The above limitations survive termination of these Terms.
Indemnification
Each user agrees to defend, indemnify, and hold harmless Dashrobe (its affiliates, officers, and employees) from any loss, damage, claim or expense (including reasonable attorneys' fees) arising from: (a) your breach of these Terms; (b) your violation of law or third-party rights; (c) any content you submit or share; or (d) your actions in using the Services. For example, if a Vendor sells a counterfeit item, the Vendor must indemnify Dashrobe against claims related to infringement. This indemnity applies even if negligence by Dashrobe is involved.
Intellectual Property
- Platform Content: All intellectual property rights in the Dashrobe app and website (trademarks, logos, text, graphics, software) are owned by Dashrobe or its licensors. Users may not copy, modify, or use Dashrobe's IP except as authorized to use the Services.
- User Content: Vendors grant Dashrobe a license to display product images/descriptions on the platform. Customers grant Dashrobe a license to use any feedback or reviews they post. Users must not post content that infringes others' IP. If notified of IP infringement in content provided by a user, Dashrobe may remove that content.
- Third-Party Licenses: Vendors warrant they have the right to sell all products listed. If a Vendor's product listing violates IP rights, the Vendor will hold Dashrobe harmless.
Privacy and Data Handling
- Privacy Policy: Dashrobe's Privacy Policy is incorporated by reference. It explains what personal data is collected (e.g. name, address, payment info) and how Dashrobe uses and shares it. Users agree to Dashrobe's collection and processing of their data as described.
- Data Sharing: To fulfill orders, Dashrobe will share relevant data (name, address, order details) with Vendors and Couriers. Dashrobe will not sell personal data to unrelated third parties.
- Data Security: Dashrobe implements industry-standard security measures to protect personal data. However, absolute security cannot be guaranteed. Users should notify Dashrobe of any suspected breach.
- User Communications: Dashrobe may contact you by email, SMS, or app notifications for order updates or marketing. You may opt out of marketing communications.
Termination
- User Termination: You may terminate your account at any time by contacting Dashrobe support or via account settings. Termination does not affect obligations for orders already placed.
- Dashrobe Termination: Dashrobe may suspend or terminate your account if you breach these Terms (e.g. fraudulent activity, illegal items, policy violations), or for any other reason with notice. Upon termination, you may not attempt to access the service.
- Effect of Termination: If this Agreement ends, outstanding rights and liabilities (payments owed, indemnification, limitations, etc.) remain in effect. Sections on Liability, Indemnity, IP, Privacy, and Dispute Resolution survive termination.
Amendments
Dashrobe may modify these Terms at any time (for example, to reflect new features, legal changes, or business needs). Updated terms will be posted on the Dashrobe site or app with an effective date. Continued use of Dashrobe after the change date means you accept the changes. If you do not agree, you must stop using Dashrobe.
